1. Agreement to these Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website at https://www.latoya4maryland.com/ and related online services operated by Friends of LaToya Nkongolo (“we,” “us,” or “our”) (the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. Who we are; political nature of the Site
We are a candidate campaign committee in Maryland supporting LaToya Nkongolo. The Site is political speech and campaign or issue advocacy. Nothing on the Site is legal, tax, or investment advice. Views expressed are those of the organization or the attributed speaker and are not official statements of any government body.
Campaign material on the Site includes the authority line required by Maryland Election Law Article §13-401: “Paid for by Friends of LaToya Nkongolo, Janelle Williams, Treasurer.”
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to donate, create an account (if offered), or submit volunteer information. Parents or guardians are responsible for any use by minors.
4. Contributions and payments
If the Site accepts donations:
- Contributions to Friends of LaToya Nkongolo are not tax-deductible as charitable contributions.
- Federal law prohibits contributions from foreign nationals (except lawful permanent residents where permitted under current FEC rules), federal contractors where prohibited, national banks, and federally chartered corporations. Maryland law imposes additional source and limit rules. By donating you represent that you are a U.S. citizen or lawful permanent resident, that the contribution is from your own funds, and that you are not a prohibited source.
- We may request employer and occupation information as required by law. Dummy or incomplete donor information may cause us to refund or reject a contribution.
- Payment processing is handled by Anedot. Anedot’s terms also apply.
- We may refund or refuse any contribution in our discretion or as required by law.
Contribution limits, reporting thresholds, and prohibited-source rules change. Do not treat this section as a complete statement of FEC or Maryland law.
5. Volunteer, petition, and contact forms
By submitting a form you represent that the information is accurate and that you have authority to provide it. Submitting a form does not create an employment, contractor, or fiduciary relationship. We may or may not follow up.
6. Email and text messages
If you subscribe to email, we may send updates, fundraising appeals, and event notices. You can unsubscribe at any time.
If you opt in to SMS, you agree to the text-messaging terms in our Privacy Policy. Friends of LaToya Nkongolo may send campaign updates and/or donation solicitations, including automated messages, to the number you provided. Message frequency varies. Message and data rates may apply. Reply STOP to end and HELP for help. Consent is not required to donate. The form checkbox is optional and unchecked by default. We will not sell or share your SMS opt-in or mobile number for third-party marketing. Unauthorized use of our numbers or short codes is prohibited.

7. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose, including prohibited contributions or impersonation;
- Scrape, harvest, or bulk-download the Site except through documented public APIs we provide, if any;
- Interfere with security, rate limits, or other users;
- Post defamatory, obscene, threatening, or infringing content if comments or user submissions are enabled;
- Upload malware or attempt to probe our systems; or
- Misrepresent affiliation with us.
We may suspend access, remove content, or refer conduct to law enforcement.
8. User content
If you submit content (comments, testimonials, uploads, or similar), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, publish, and display that content in connection with the campaign, in any media. You represent you own or control the rights. We may edit or decline to use submissions. You keep ownership of your content; the license lets us operate the Site and the campaign.
9. Intellectual property
The Site, including text, graphics, logos, video, and compilation, is owned by us or our licensors and protected by U.S. and Maryland intellectual-property law. You may share pages and official graphics for personal, non-commercial political speech that does not suggest false endorsement. You may not copy the Site wholesale, scrape donor or volunteer lists, or use our marks in a way that confuses the public about who paid for a communication.
10. Third-party services and links
The Site may link to social networks, news outlets, petition tools, and payment processors, including Anedot. We are not responsible for their content, availability, or practices. Your use of those services is between you and them.
11. No professional advice; political speech
Content is for information and advocacy. Elections, legislation, and court decisions change. Verify filing deadlines, polling locations, and legal requirements with official sources (Maryland State Board of Elections, local boards, FEC).
12. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that content is complete or current.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, TREASURER, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND VENDORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU DONATED THROUGH THE SITE IN THE THREE MONTHS BEFORE THE CLAIM. Some states do not allow certain limitations; those limitations apply only to the extent permitted.
14. Indemnity
You will defend and indemnify us and our officers, treasurer, staff, and volunteers against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your content, your violation of these Terms, or your violation of law.
15. Copyright complaints
If you believe content on the Site infringes your copyright, send a notice to latoya4maryland@gmail.com with: your signature, identification of the work and the allegedly infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We may remove content and, in appropriate cases, terminate repeat infringers.
16. Changes; termination
We may change the Site or these Terms at any time. The “Last Updated” date will change. Continued use after changes means you accept the new Terms. We may stop offering the Site or suspend your access without notice.
17. Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules, and by applicable federal law (including FECA where it applies). Exclusive venue for disputes is the state or federal courts located in Anne Arundel County, Maryland, or the U.S. District Court for the District of Maryland, unless campaign-finance or other statute requires a different forum. You waive any objection to that venue.
You and we agree to attempt good-faith informal resolution for 30 days before filing a claim. This does not limit either party’s right to seek injunctive relief or to comply with a government investigation.
18. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site. If a provision is unenforceable, the rest remains in effect. We may assign these Terms in connection with a committee restructuring, merger of efforts, or transfer permitted by law. You may not assign them. Failure to enforce a provision is not a waiver. Headings are for convenience only.
